HIRING POLICIES

Komalingua offers Spanish courses adapted to different levels and learning needs.

To ensure the proper organization and operation of the Spanish courses, the following general conditions apply:

1. Registration and Payments

  • Registration for a course will be effective once the corresponding payment, in full or in part, has been made, according to the terms agreed upon with the academy.
  • Courses can be paid for in a single payment (cash, card, or bank transfer) or by direct debit with prior written authorization from the student.
  • The opening of new groups will be subject to the availability of teachers, classrooms, and a minimum number of students. If this number is not reached, an alternative or a full refund will be offered.
  • Group courses follow the local academic calendar; official holidays are included in the fees and cannot be made up.

CANCELLATION POLICY

1. Cancellations by the Student

Students may request to cancel their enrollment in a course, class, or training service, provided that the request is made in accordance with the following conditions:

  • Cancellation must be communicated at least 15 calendar days before the start date of the course or scheduled class.
  • The request must be made in writing through the channels provided by KOMALINGUA, S.L.:

To cancel a private class, the student must notify the teacher or the administration at least 24 hours in advance. Otherwise, the session will be considered completed and cannot be rescheduled.

Depending on when the cancellation request is made, KOMALINGUA, S.L. may apply cancellation fees, retain all or part of the amounts paid, or not issue a refund, in accordance with the specific terms and conditions of the contracted service.

Once the course or training service has started, cancellations and refunds will not be accepted, except as otherwise provided by law or by express written agreement.

2. Course or Class Modifications

Requests for modifications (change of schedule, group, format, start date, or other aspects) are subject to availability and must be requested at least 15 days in advance.

KOMALINGUA, S.L. reserves the right to accept or reject such requests and, where applicable, to apply any corresponding administrative costs or price differences.

Private classes are personal and non-transferable.

3. Student Absence

Student absence from classes, sessions, or courses without prior notification will not entitle the student to a refund, make-up classes, or financial compensation. The service will be considered as having been provided.

4. Cancellations or Modifications by the Student

If a student wishes to cancel their participation in a course, they must notify KOMALINGUA, S.L. in writing at least 15 days before the start or renewal of the course.

In the case of a justified cancellation before the start of the course, the amount paid will be refunded, less any applicable administrative costs.

Once the course has started, no refunds will be issued, except in cases of force majeure duly accredited (serious illness, relocation, etc.).

5. Cancellations or Modifications by KOMALINGUA S.L.

KOMALINGUA, S.L. reserves the right to cancel, postpone, or modify a course or class for organizational or academic reasons, insufficient enrollment, force majeure, or any other circumstance beyond its control.

In such cases, the student may choose between:

  • Relocation to another equivalent course or group.
  • A full or partial refund of the amounts paid, as applicable.

6. Refunds

In the event of a justified cancellation before the start of the course, the amount paid will be refunded, less any applicable administrative fees.

Once the course has started, no refunds will be issued, except in cases of duly documented force majeure (serious illness, relocation, etc.).

If the course cannot be held for reasons beyond the student's control (for example, cancellation of the group due to insufficient enrollment), KOMALINGUA, S.L. We will refund 100% of the amount paid or offer an equivalent alternative.

When a refund is due, it will be issued using the same payment method used by the student and within approximately 7 business days of cancellation confirmation.

7. Individual Lessons and Make-up Sessions

Private lessons are personal and non-transferable.

To cancel a private lesson, the student must notify the teacher or the administration at least 24 hours in advance. Otherwise, the session will be considered completed and cannot be made up.

8. Personal Data Protection (GDPR)

The personal data provided by students in the context of enrollment and cancellation management will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and current data protection legislation.

This data will be used exclusively for the administrative, academic, and financial management of the contractual relationship, including the processing of cancellations and refunds, and will not be transferred to third parties except where legally required.

Students may exercise their rights of access, rectification, erasure, objection, restriction of processing, and data portability at any time, as indicated in our Privacy Policy.

RIGHT OF WITHDRAWAL

What is it?

The right of withdrawal is the consumer's right to cancel a contract without having to justify their decision, by notifying the other contracting party within the established timeframe, and without any penalty.

Clauses that impose a penalty on the consumer for exercising the right of withdrawal are null and void.

It will be considered valid when exercised by:

  • Sending the withdrawal form.
  • Returning the products received.

It is important to note that the right of withdrawal must be exercised in a way that provides proof of its exercise, as the burden of proof rests with the consumer, and that it was exercised within the established timeframe. Therefore, it is recommended to do so in a way that provides proof of delivery (for example, registered mail with acknowledgment of receipt, etc.).

Cases in which the right of withdrawal applies

The right of withdrawal exists in the following cases:

  • In cases provided for by law or regulation.
  • When it is recognized in the offer, promotion, advertisement, or in the contract itself.

Some laws establish the possibility of exercising this right, recognizing it in the following cases:

  • Contracts concluded remotely.
  • Contracts concluded outside of business premises.
  • Package travel contracts.
  • Remotely marketed financial services contracts.
  • Timeshare contracts.

Effects of exercising the right of withdrawal

When the law grants the right of withdrawal, KOMALINGUA, S.L. will inform the customer in writing, clearly, comprehensibly, and precisely, of this right, as well as the requirements and consequences of exercising it, in the contract. It will also provide a withdrawal form, clearly identified as such, stating the name and address of the person to whom it should be sent and the contract identification details and those of the contracting parties.

Provided that KOMALINGUA, S.L. has fulfilled its duty to inform, the withdrawal period will begin from the date of receipt of the goods, or from the date of the contract if the contract is for the provision of services.

If KOMALINGUA, S.L. has not fulfilled its duty to provide information and documentation regarding the right of withdrawal, the withdrawal period will begin three months from the date the goods were delivered or the contract was entered into, if the contract is for the provision of services. If the duty to provide information and documentation is fulfilled during the aforementioned three-month period, the legally established period for exercising the right of withdrawal will begin to run from that moment.

Exercising the right of withdrawal will not entail any expense for the consumer.

In the case of distance contracts, KOMALINGUA, S.L. may require the consumer to bear the direct cost of returning the goods or services.

The primary consequence of the right of withdrawal is the reciprocal restitution of the benefits.

KOMALINGUA, S.L. will therefore be obliged to return the sums paid without deducting any expenses within a maximum period of 30 days from the date of withdrawal. If this period elapses without the consumer having received the refund, they will have the right to claim double the amount, without prejudice to any additional compensation for damages incurred in excess of that sum.

When the price to be paid in the contract for which the right of withdrawal is exercised has been totally or partially financed by means of a credit granted by the contracting party or by a third party, with prior agreement between the latter and the contracting party, the exercise of the right of withdrawal will at the same time imply the termination of the credit without any penalty.

The consumer will not have to reimburse any amount for the decrease in the value of the goods resulting from their use in accordance with the agreement or their nature, or from the use of the service.

Furthermore, they will be entitled to reimbursement of any necessary and useful expenses incurred in relation to the goods.

The impossibility of returning the goods under the contract due to loss, destruction, or other cause will not preclude the right of withdrawal.

In these cases, when the impossibility of return is attributable to the consumer, the consumer will be liable for the market value the goods would have had at the time the right of withdrawal was exercised, unless that value was higher than the purchase price, in which case the consumer will be liable for the purchase price.

When KOMALINGUA, S.L. has failed to fulfill its duty to provide information and documentation regarding the right of withdrawal, the impossibility of return will only be attributable to the consumer if they have failed to exercise the diligence required of them in their own affairs.
